Stichting Volkswagenaudiclaim
Berth Brouwer represents Stichting Volkswagenaudiclaim in its class action against the manufacturer, importers and dealers of Volkswagen, Audi, Seat and Skoda regarding the diesel scandal at Volkswagen. Volkswagen has admitted that it installed rigged software in certain diesel engines to circumvent environmental standards. The foundation’s object is to recover all the loss incurred by car owners due to the diesel fraud from Volkswagen and the importers and dealers of those cars.
Volkswagen is fully responsible for the loss incurred, which, moreover, it wilfully created. Car owners must therefore be fully indemnified against all the loss incurred as a result of the emission fraud committed by Volkswagen.
Diesel scandal
Volkswagen AG wilfully committed fraud with regard to the software of the engine management of no less than 11 million cars of various car makes of the group.
Volkswagen installed software in several car makes, including Volkswagen, Audi, Skoda and Seat, by means of which a diesel engine could recognise that it was undergoing an emission test. As soon as the engine’s software realised that a test was being performed, it temporarily switched to clean combustion. The clean combustion was terminated after the test. That way Volkswagen was able to convince the public that it produced clean diesel cars in theory, which had the driving qualities of much more polluting diesels in practice. Volkswagen has now admitted that 11 million vehicles have been fitted with this software, 160,000 of which in the Netherlands.
